WASHINGTON, D.C. — The Department of Health and Human Services (HHS) Centers for Disease Control and Prevention (CDC) has issued a final rule removing HIV from the definiion of communicable disease of public health significance and remove references to HIV from the scope of medical examinations for aliens. The change removes HIV from the list of communicable diseases that would render an alien “inadmissible” to the United States. As a result of the rule, aliens will no longer be inadmissible to the Unite States solely on the basis of HIV infection, nor will aliens be required to undergo HIV testing as a part of the required medical examination. The final rule will be effective on January 4, 2010.
