On August 27, 2026, The Chander Law Firm’s Managing Attorney, Vishal Chander, participated in “TPS in Transition: AABANY & AALDEF Immigration Relief Training & How to Help,” a webinar presented by the Asian American Bar Association of New York (AABANY) and the Asian American Legal Defense and Education Fund (AALDEF).
The program addressed the changing legal landscape surrounding Temporary Protected Status (TPS) and the immigration options that may be available to individuals whose TPS has ended or may soon end.
Immigration Relief After TPS
Vishal’s portion of the program focused on an important practical question: What immigration options may remain available after a person loses TPS?
The discussion covered a range of potential remedies, including:
- Family-based immigration and adjustment of status
- Employment-based immigration options
- Administrative and judicial stays of removal
- Asylum, withholding of removal, and protection under the Convention Against Torture
- Special Immigrant Juvenile Status and other special immigrant categories
- Cancellation of removal for certain nonpermanent residents
The program emphasized that the end of TPS does not produce the same immigration consequences for every individual. The available options depend on the person’s individual immigration history, including how the person entered the United States, whether another immigration status was maintained, family relationships, prior immigration proceedings, and whether an existing removal order is already in place.
TPS Does Not Resolve the Underlying Immigration History
One important issue discussed during the program is that TPS does not itself constitute an admission into the United States and does not cure an earlier unlawful entry or prior period without lawful status. Those distinctions can affect whether a former TPS holder may qualify for adjustment of status or another immigration benefit.
For that reason, individuals affected by the loss of TPS should have their entire immigration history reviewed, rather than assuming that the expiration of TPS necessarily means that no other immigration options are available.
AABANY Supporting Affected TPS Holders
The webinar also highlighted opportunities for attorneys and community members to assist individuals affected by the loss of TPS. AABANY’s Immigration Law Committee and Issues Committee, in coordination with AALDEF, are recruiting volunteers to support legal screenings, consultations, and other assistance for individuals affected by TPS termination.
